TERMS AND CONDITIONS OF SALE

The Terms and Conditions of Sale have been drawn up and are made known to the CUSTOMERS, in compliance with the obligations established in Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).

Organic Law 3/2018 of 5 December 2018 on the Protection of Personal Data and Guarantee of Digital Rights and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data also apply.

2.-PURPOSE

The purpose of these Terms of Sale is, on the one hand, to inform potential CUSTOMERS of the conditions and modalities under which GOIKO proceeds with the sale and delivery of the products offered (hereinafter, the ‘Products’) and, on the other hand, to define the rights and obligations of the parties within the framework of the sale of Products by GOIKO to the CUSTOMER (hereinafter, the ‘Customer’), who declares in all cases to be over fourteen years of age and to have the necessary legal capacity to enter into a contract.

These Terms of Sale shall apply, without restriction or reservation, to all sales of Products offered by GOIKO on its website accessible at www.goiko.com (hereinafter referred to as the ‘Website’).

placement of an order for Products offered for sale on the Website (hereinafter, the ‘Order’) implies full and complete acceptance by the CUSTOMER of these Conditions of Sale, knowledge of which prior to placing the Order is acknowledged by the Customer.

GOIKO reserves the right to modify these Terms and Conditions of Sale at any time. However, the Terms and Conditions of Sale applicable to the Order shall be those accepted by the Buyer at the time of placing the Order.

These Terms and Conditions of Sale shall be supplemented by the Terms of Use and Legal Notice, the Special Conditions that may be applicable from time to time and the Privacy and Cookies Policy.

 

3.-COMMUNICATIONS: 

The user, by virtue of the present, is fully informed of the effects described in the aforementioned Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce and may contactGOIKO free of charge, quickly and directly through dimedime@goiko.com.

5.-HOW TO PLACE AN ORDER: REALIZAR UN PEDIDO:

Before placing your order, if you have any allergies, you can check in the ALLERGENS section the ingredients of each one of the products.

To place an order online, you can access the website www.goiko.com where you can view the different products and the corresponding information.

First of all, at the top right-hand side of the page, you can access the ORDER section, which offers you two options:

If you wish to place your order online and pick it up at the selected establishment, click on COLLECT AT LOCAL PREMISES. If you wish to place your order online and receive it at home, click on HOME DELIVERY.

 

5.1 WE’LL BRING IT TO YOUR DOOR (HOME DELIVERY):

The CUSTOMER can decide whether the delivery service of the Order is carried out by GOIKO or by a selected third party (UBER EATS, GLOVO, JUST EAT). 

If you choose GOIKO, the delivery service shall be governed by these terms and conditions. In the case of selecting a third party for the service, the terms and conditions shall be governed by the general terms and conditions of the third party.

After selecting the GOIKO restaurant that will prepare the order, you then choose the desired product(s) and customise it/them to your liking, for example in the case of hamburgers you can choose how the meat is cooked, or add different extras.

If you access your BASKET you will be able to see the products added, the price of each one and the total of the order.

If you wish to remove any products from the shopping list, you can do so at any time.

On the other hand, if you wish to continue with the purchase by clicking on ORDER, you will have to provide a series of personal details and the place of delivery of the order which is necessary to process the order. This will then be processed in accordance with the site’s Privacy Policy, for the purposes of processing the order.

To continue with the purchase, once you have provided this information and reviewed and accepted the Privacy Policy, click on CONTINUE TO PAYMENT.

The order will be confirmed by making the payment through the following accepted METHOD OF PAYMENT: Credit/debit card: by means of PAYCOMET virtual POS provided during the purchase process.

GOIKO shall not be liable for any error that the USER may make when providing the delivery address. The delivery time shall be indicative and shall in no case be binding on the Service. GOIKO accepts no liability for any delays caused by reasons beyond GOIKO’s control.

 

5.2. PICK YOUR ORDER UP AT GOIKO (PICK IT UP AT THE RESTAURANT):

After selecting the preferred GOIKO restaurant, you can select the desired product(s) and customise it/them to your liking, for example in the case of hamburgers you can choose how the meat is cooked, or add different extras.

If you access your BASKET you will be able to see the products added, the price of each one and the total of the order.

If you wish to remove any products from the shopping list, you can do so at any time.

On the other hand, if you wish to continue with the purchase, click on ORDER, then you must select the delivery time and provide a series of personal data which is necessary to process the order. This will then be processed in accordance with the site’s Privacy Policy, for the purposes of processing the order.

To continue with the purchase once this information has been provided and the Privacy Policy has been reviewed and accepted, click on COMPLETE PURCHASE.

Then, you will be able to review the data entered and the terms and conditions of sale. If you agree, click on PAY BY CARD to proceed with the payment of the order through a secure platform.

The order will be confirmed by making the payment through the following accepted METHOD OF PAYMENTT-A: Credit/debit card: by means of PAYCOMET virtual POS provided during the purchase process.

The products ordered by the CUSTOMER through the GOIKO website will be made available to the CUSTOMER at the time and in the establishment indicated when placing the order.

 

5.3.  CONFIRMATION OF THE ORDER

The placing of an Order is equivalent to the acceptance of these Terms and Conditions of Sale, accepting that this implies that the CUSTOMER is obliged to pay the prices, quantities, characteristics and delivery times of the Products ordered by the CUSTOMER.

During the Order process, the CUSTOMER must provide certain mandatory personal data, the processing of which will be subject to the Privacy Policy, which must be accepted before the Order is placed. Refusal to provide the required personal data will prevent the Order from being placed.

The Order will be confirmed by GOIKO by sending an email to the , and an SMS to the mobile number entered. GOIKO accepts no responsibility in the event of an error when entering the email address or mobile phone number, or in the event of non-receipt of the Order confirmation email or SMS. In these cases, the sale shall be final, except in the event of cancellation of the Order by GOIKO, in particular in the event of unavailability of certain Products.

GOIKO shall be authorised to charge the full price corresponding to the said Order as from the sending of the e-mail informing the CUSTOMER of the confirmation of their Order, with an indication of the approximate delivery period of the same.

 

6.- PRODUCTS AND PRICES:

6.1.  PRODUCTS

In accordance with the applicable regulations, the Customer shall have the possibility, prior to placing an Order, of finding out on the Website the fundamental properties of the Product(s) that he/she wishes to purchase.

Regardless of the type of products desired, GOIKO provides the CUSTOMER with the relevant information in each case in accordance with current legislation. You can find it on the product sheet of each product.

Although all necessary precautions are taken, some Products may contain allergenic products. GOIKO urges CUSTOMERS who suffer from any type of allergy, food disorder or similar to consult the list of allergens provided on the Website, in accordance with the provisions of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers.

6.2.  ANOMALIES, DAMAGE, NON-CONFORMITY

The CUSTOMER shall communicate the lack of conformity with the delivered Order to GOIKO Customer Service via the official WhatsApp channel or the following address: dimedime@goiko.com.

GOIKO Customer Service may request any information relating to the identity of the CUSTOMER or the recipient of the Order and may carry out any verifications that may be necessary for the case.

 

6.3. SALE OF ALCOHOLIC BEVERAGES

In accordance with applicable legislation, the sale of alcoholic beverages to persons under the age of 18 is prohibited. GOIKO reserves the right to suspend or cancel the delivery of an Order, regardless of its nature and degree of execution, in the event that it suspects that the CUSTOMER is a minor, reserving the right to demand the presentation of an ID card or equivalent identity document from the person receiving the Order.

Furthermore, GOIKO reserves the right to suspend or cancel the delivery of alcoholic beverages included in an Order in accordance with the regulations on time limits for the sale of alcoholic beverages applicable to the establishment in question.

GOIKO encourages responsible consumption.

 

6.4. PRICE: 

The price of GOIKO products will be available at all times to the CUSTOMER of the website and will be shown in euros.

In any case, the CUSTOMER, prior to the formalisation of the contract, shall have access to information on the prices of the products. Prices will include the indirect taxes applicable on the date of the Order.Any change in the applicable tax rate will be automatically reflected in the price of the Products sold by GOIKO on the Website.

The price of the product may be modified unilaterally and at any time by GOIKO and the update will be published in the products and services section of the portal.

The prices in force for each purchase process will be those published at that time in the section relating to it.

 

7.- PAYMENT AND MEANS OF PAYMENT: 

7.1 Order Confirmation

The order will be confirmed by making the payment which will be done through the accepted METHODS OF PAYMENT.

Prior to such confirmation, the customer may abandon the purchase at any time. Once the order has been confirmed, the provisions of the sections ‘Cancellation’ and ‘Withdrawal’ shall apply.

Once the payment has been made, the CUSTOMER will receive an e-mail with the order confirmation.

During the purchase process, before making the payment, the CUSTOMER will be able to modify the details of their order.

You may also cancel any order request before confirming it definitively. If the order has already been confirmed, the provisions of the sections ‘Cancellation’ and ‘Withdrawal’ shall apply.

7.2 Purchase Ticket:

This will be delivered with your order to your home or, if applicable, at the establishment when you collect your order and you will be able to request an receipt via the portalInvoicing – Goiko.

 

8.- ORDER CANCELLATION

If you wish to cancel your order, you may do so as long as the preparation of your order has not yet begun.

To do so, you will need to contact GOIKO’s Customer Service department via the link to the official WhatsApp profile indicated in the communications related to the order.

We will let you know which establishment is handling your order as soon as we start to process your order.

 

9.- RIGHT OF WITHDRAWAL

GOIKO informs the CUSTOMER that in accordance with articles 102 and 103 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, there is no right of withdrawal in contracts for the supply of goods made according to the specifications of the consumer or clearly personalised or which, due to their nature, cannot be returned or may deteriorate or expire rapidly.

 

10.- LEGAL GUARANTEE

The very nature of the goods marketed by GOIKO , since they are perishable products, limits the application of the warranty period established in the Law, which would otherwise be 2 years.

GOIKO shall therefore be liable for any lack of conformity existing at the time of delivery of the product insofar as the nature of the same allows.

In these cases, the product will be replaced at no cost to the CUSTOMER.

The products are deemed to be in conformity with the contract provided that (i) they conform to the description given and possess the qualities presented on this website, (ii) they are fit for the uses for which products of the same type are normally intended and (iii) they present reasonably expected quality and performance that is customary for a product of the same type.

 

  1. PARTIAL NULLITY

If any of these Terms and Conditions or any provision of a contract is declared null and void by a final decision of a competent authority, the remaining terms and conditions shall remain in full force and effect and shall not be affected by such declaration of nullity.

 

  1. APPLICABLE LAW AND JURISDICTION

These terms and conditions and all disputes arising in connection with these terms and conditions, including the validity of these terms and conditions, or with the use of the Website or any purchase from the Website shall be governed by Spanish law.

For disputes and questions arising in connection with the contract, the courts and tribunals of your place of residence shall have jurisdiction.

Once formalised, the CUSTOMER will be provided with an identification code and written proof of the same to the e-mail address provided and it will be processed as soon as possible.
